2. Terms of use and services
Use of the Covalorag site and application implies full acceptance of the following terms of use. These terms may be modified or supplemented at any time; users are therefore invited to consult them regularly.
The site is normally accessible to users at all times. COVALORIS may, however, decide to interrupt access for technical maintenance and will endeavour to inform users in advance of the dates and times of any intervention.
The Covalorag site is updated regularly by COVALORIS. The legal notice and this privacy policy may be modified at any time; they are binding on the user, who is invited to refer to them as often as possible.
3. Description of services
The Covalorag site and application aim to provide information and tools relating to the activities and services of Covaloris.
COVALORIS endeavours to provide information that is as accurate as possible. However, it cannot be held responsible for omissions, inaccuracies or failures to update, whether caused by itself or by third-party partners. All information on the site is provided for guidance only and is subject to change. The information on the site is not exhaustive and is subject to changes that may have been made since it was put online.
4. Contractual limitations on technical data
The site uses JavaScript and modern web technologies. COVALORIS cannot be held responsible for material damage linked to the use of the site. In addition, the user undertakes to access the site using recent, virus-free equipment and an up-to-date browser.
5. Intellectual property
COVALORIS owns the intellectual property rights or holds the rights of use over all elements accessible on the site (texts, images, graphics, logo, icons, software, etc.). Any reproduction, representation, modification, publication or adaptation of all or part of the site’s elements, by any means or process, is prohibited without prior written authorisation from COVALORIS. Any unauthorised use of the site or any of its contents will be considered as constituting an infringement and pursued in accordance with the provisions of Articles L.335-2 et seq. of the French Intellectual Property Code.
6. Limitation of liability
COVALORIS may not be held liable for direct or indirect damage caused to the user’s equipment when accessing the site, resulting either from the use of equipment that does not meet the specifications indicated in section 4, or from the appearance of a bug or incompatibility.
COVALORIS may not be held liable for indirect damage (such as loss of business or loss of opportunity) resulting from use of the site. Interactive areas (e.g. contact form) are available to users. COVALORIS reserves the right to remove, without prior notice, any content that contravenes applicable legislation in France, in particular provisions relating to data protection. COVALORIS also reserves the right to hold the user civilly and/or criminally liable, in particular in the case of racist, offensive, defamatory or pornographic content, regardless of the medium used (text, photograph, etc.).
7. Personal data
In France, personal data is protected in particular by Law n° 78-87 of 6 January 1978, Law n° 2004-801 of 6 August 2004, Article L. 226-13 of the Criminal Code and European Directive 95/46/EC of 24 October 1995.
When using the Covalorag site, the following may be collected: the URL of the links used to access the site, the user’s access provider, and the user’s IP address.
COVALORIS only collects personal data when necessary for the services offered by the site. The user provides this information in full knowledge, in particular when entering it themselves. The user is informed whether providing this information is obligatory or optional.
In accordance with Articles 38 et seq. of Law 78-17 of 6 January 1978 on data processing and freedoms, any user has the right to access, rectify and object to their personal data by sending a signed written request, together with a copy of an identity document bearing the signature of the holder, and specifying the address to which the response should be sent.
No personal data of the user of the Covalorag site is published, exchanged, transferred, assigned or sold to third parties on any medium without the user’s knowledge. The only exception would be the sale of COVALORIS and its rights, which would allow the transmission of such data to the purchaser, who would in turn be bound by the same obligations of retention and modification of data with regard to the user.
The site is not declared to the French data protection authority (CNIL) insofar as it does not process personal data in the manner described on this page.
Databases are protected by the provisions of the Law of 1 July 1998 transposing Directive 96/9/EC of 11 March 1996 on the legal protection of databases.
8. Hyperlinks and cookies
The Covalorag site may contain hyperlinks to other sites, set up with the authorisation of COVALORIS. However, COVALORIS cannot verify the content of sites visited in this way and assumes no responsibility for them.
Browsing the Covalorag site may result in the installation of cookie(s) on the user’s computer. A cookie is a small file that does not identify the user but records information relating to the navigation of a computer on a site. The data thus obtained is intended to facilitate subsequent navigation on the site and may also be used for various traffic measurements.
Refusing to install a cookie may make it impossible to access certain services. 9. Applicable law and jurisdiction
Any dispute relating to the use of the Covalorag site is subject to French law. Exclusive jurisdiction is granted to the competent courts of Paris.
